{"id":136,"date":"2013-02-18T14:51:44","date_gmt":"2013-02-18T14:51:44","guid":{"rendered":"\/2013\/02\/18\/convicted-foreign-criminals-and-the-right-to-family-life\/"},"modified":"2013-02-18T14:51:44","modified_gmt":"2013-02-18T14:51:44","slug":"convicted-foreign-criminals-and-the-right-to-family-life","status":"publish","type":"post","link":"https:\/\/www.migrationwatchuk.org\/news\/2013\/02\/18\/convicted-foreign-criminals-and-the-right-to-family-life\/","title":{"rendered":"Convicted Foreign Criminals and the Right to Family Life"},"content":{"rendered":"<p>The paper which appears below under<br \/>\nthe title \u201cConvicted foreign criminals and the right to family life (2)\u201d was<br \/>\ncompleted on 13 February 2013.&#0160; It is<br \/>\nappropriate to precede it with further comments following the Home Secretary\u2019s<br \/>\narticle on the subject which appeared in The Mail on Sunday on 17 February.&#0160; The Home Secretary accuses the judges of<br \/>\ndisregarding the will of Parliament in failing to implement the provisions of<br \/>\nHC 194 (see below for an explanation of HC 194) when considering appeals<br \/>\nagainst deportation by convicted foreign criminals.&#0160; Her anger appears to have been provoked by<br \/>\nthree recent decisions of the Upper Tribunal (Immigration and Asylum Chamber),<br \/>\nthe most recent of which is discussed below.<br \/>\nOne of her complaints is that \u201csome judges seem to believe that they can<br \/>\nignore Parliament\u2019s wishes if they think that the procedures for parliamentary<br \/>\nscrutiny have been weak\u201d.&#0160; This appears<br \/>\nto be a reference to another case <em>Izuazu <\/em>[2013]<br \/>\nUKUT 45.
